1. CLIENT AND PARTICIPANT COMPANIES
These General Terms and Conditions of Contract (hereinafter, ‘the General Terms and Conditions’) regulate the commercial relationship that arises between, on one side, the user or client, and on the other side, the company Terranam Consulting SL (the company providing the tourism service). The full identification details of the participant companies are as follows:
Tourism company: TERRANAM CONSULTING S.L. (hereinafter, ‘Terranam’), with registered office at c/Fuencarral 139, 2C (28010 Madrid) and email info@terranam.com, holder of Tax Id. No. CIF B-05411236, registered in the Company Register of Madrid.
2. GENERAL TERMS AND CONDITIONS OF THE WEBSITE
2.1 INTRODUCTION
The purpose of this document is to establish and regulate the rules of use and safeguarding of information of the website www.terranamwellness.com (hereinafter, ‘the Website’), the term ‘Website’ signifying all of the pages and contents owned by Terranam which are accessed through the domain www.terranamwellness.com and its subdomains.
The owner of the Website is TERRANAM CONSULTING S.L.
Through the Website, Terranam seeks to provide its clients with information, room reservation and tourism-related activities, as well as any other service which at the time is deemed appropriate for properly achieving its corporate purpose.
These general terms and conditions regulate the use of the Website service that Terranam makes available to Internet users. By using the Website, you are considered a user of it (hereinafter, ‘the User’), which signifies that you fully and unreservedly accept all of the General Terms and Conditions published by Terranam at the very moment you access the Website and should be aware of the importance of reading them every time you visit the Website.
By accessing the Website, the User is agreeing to be bound by the following General Terms and Conditions, which Terranam recommends that the User print or download and carefully read every time that he/she accesses it. Furthermore, use of the Service is also subject to all notices, regulations of use and instructions brought to the attention of the User by Terranam, which complete the provisions of these General Terms and Conditions, provided that they are not incompatible with them.
2.2 USE OF TERRANAM’S ONLINE RESERVATION SERVICES
2.2.1) Online reservation services.
The purpose of these services is the reservation of rooms. By using these services, the User is fully and unreservedly accepting all of the General Terms and Conditions contained in the latest published version and their validity.
2.2.2) Terms and conditions of contract: When using the service, the User will receive a confirmation email. This email serves as proof of reservation and confirmation of acceptance.
2.2.3) Guarantee and cancellation policy: Reservations made through this page will be guaranteed by means of the credit card entered by the User on the form. Late cancellation (deadline clearly stated on booking terms and conditions) will result in an automatic charge to the credit card of the amount corresponding to one or more nights, as well as the cancellation of the reservation, except in cases where the client has opted for a ‘Non-refundable offer’, in which case, cancellation will result in the total forfeiture of the amount of the stay, which TERRANAM is entitled to keep if it has already been paid, charge to the client’s debit/credit card or claim by any other valid means provided for by the law. In either case (refundable or non-refundable offer), failure to appear at check-in, without prior notice before the deadline (clearly stated on booking terms and conditions) will result in the total forfeiture of the amount of the stay, which TERRANAM is entitled to keep if it has already been paid, charge to the client’s debit/credit card or claim by any other valid means provided for by the law. To cancel a reservation, you can contact the establishment of destination from Monday to Sunday or send an email to info@terranam.com.
2.3 USE OF SERVICES
The User undertakes to use all services in accordance with the law, morality, good practice and public order, as well as the provisions of these General Terms and Conditions of Contract. Consequently, the User is required to refrain from using the services for purposes that are illicit and/or contrary to the provisions of these General Terms and Conditions of Contract, that are harmful to the rights and/or interests of third parties or that, in any way, could damage the services, TERRANAM and/or its reputation, or prevent its correct functioning or that of the services it offers or could offer in the future.
2.4 SCOPE OF THE WEBSITE. USER RESPONSIBILITY
Access to the Website is the sole responsibility of the User. Any risks derived from use of the Website shall be the User’s sole and exclusive responsibility. The following are not guaranteed by TERRANAM: Website infallibility, availability, continuity, non-existence of deficiencies and security; Website content or information passing through it that is free from viruses or other harmful elements; security in the use that the User makes of the Website.
TERRANAM shall accept no liability for any loss or damage that may arise from interference, omissions, interruptions, computer viruses, telephone faults or disconnections in the operation of this electronic system resulting from causes beyond the control of TERRANAM; delays or lockouts in the use of this electronic system caused by deficiencies or overloads in its Data Processing Centre, telephone lines, Internet system or other electronic systems; or damage that may be caused by third parties as a result of unlawful intrusions beyond the control of TERRANAM.
Mere access to the Website does not imply any commercial relationship between TERRANAM and the User.
2.5 WEBSITE CONTENTS
TERRANAM reserves the right to prevent or prohibit access to the Website to any Internet user who introduces any contents that are contrary to the law or immoral and to institute any legal action that it deems appropriate to prevent this type of behavior.
2.6 CORRECT USE OF WEBSITE CONTENTS
All of the Website’s contents, including, but not limited to, text, graphics, logos, icons, images, audio clips, data and software collections and their compiling (intellectual property content) are the property of TERRANAM or our sponsors, partners and licensors, and are protected by intellectual property law.
TERRANAM declares that the intellectual property rights (trademarks, trade names, etc.) that appear on the Website are owned by it and/or are legitimately protected by existing intellectual property legislation.
The User undertakes to use the Website diligently, correctly and lawfully and, in particular, undertakes to refrain from:
a) Deleting, circumventing or manipulating any copyright, trademark or other information that identifies the rights of TERRANAM or other rights holders incorporated into the contents of and/or products marketed through the Website, including technical protection devices, digital fingerprints and any information mechanisms that may contain them.
b) Using any of the contents, in particular information about TERRANAM obtained from the Website, to send publicity, communications for the purpose of direct sale or, for any other kind of commercial purpose, unsolicited messages addressed to a number of persons.
c) Reproducing or copying, distributing, allowing access to the public through any form of public communication, changing or modifying the contents, unless authorized by the holder of the corresponding rights or it is legally permissible to do so.
d) In general, using the contents for purposes that are contrary to the law, morality, generally accepted good practice or public order.
TERRANAM grants no license or permission of any kind over its intellectual property rights or any other property or right related to the Website.
2.7 INTELLECTUAL PROPERTY
The intellectual property rights over the work contained on the Website belong exclusively to TERRANAM, unless different ownership is indicated. Any unauthorized reproduction, distribution, marketing or modification of such work constitutes an infringement of the intellectual property rights of TERRANAM, or other rights holder, and may result in the instituting of any judicial or extrajudicial action to which it may be entitled in the exercising of such rights.
Furthermore, information that the User may access through the Website may be protected by intellectual or other rights. TERRANAM shall under no circumstances accept liability for any infringements of such rights committed by the User.
2.8 APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions shall be governed by Spanish law, which shall also be applicable for any eventualities that are not provided for in terms of interpretation, validity and execution.
TERRANAM and the User, expressly waiving any other jurisdiction, agree to be subject to the Courts of the city of Madrid for the resolution of any disputes that may arise from the existence, interpretation or application of the General Terms and Conditions, except for cases in which the User has the status of a consumer or user in accordance with applicable laws and this clause shall not apply.
3. RESERVATION POLICY
Your reservation and the accommodation agreement made with Terranam Wellness is subject to these Terms and Conditions.
RESERVATION REQUIREMENTS AND ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF RESERVATION
Reservations through the Website can only be made by persons of legal age and with full natural capacity to act. By making a reservation through the Website, you are expressly and unreservedly accepting these General Terms and Conditions, as well as the General Terms and Conditions of Use of the Website, which can be downloaded from the ‘General Terms and Conditions’ section of the Website, located at the bottom of the screen.
PRE-CONTRACT INFORMATION
Through the Website, you can make a reservation for tourist accommodation & services in the advertised property(ies). The reservation of accommodation & services is a contract which is signed electronically and generates certain rights and obligations for both the tourism establishment and you. The reservation and accommodation contract are subject to Spanish law and Madrid regional legislation.
By making a reservation with TERRANAM through its website, users or clients expressly declare their knowledge, understanding and acceptance of the general terms and conditions of use and reservation. Furthermore, users declare that they are of legal age and have the necessary legal capacity to access the websites of TERRANAM and enter into a contract through them. The user accepts responsibility for confidentially and responsibly safeguarding his/her identity and (where applicable) the password obtained when registering as a client, and not disclosing them to third parties.
PAYMENT OF THE RESERVATION: In the case of a reservation designated as a ‘Non-refundable offer’, the full amount will be charged to the bank card indicated within 48 hours of the reservation.
In the case of a reservation not designated as a ‘Non-refundable offer’, 50% of the amount will be charged to the bank card indicated within 48 hours of the reservation. The remaining 50% of the stay will be charged upon arrival.
CONFIRMATION OF THE RESERVATION: Once the reservation is made, the user will see the reservation confirmation on screen and can print it off as proof. The user will also be sent an email within 24 hours confirming the reservation.
CONFORMITY OF THE ACCOMMODATION: TERRANAM guarantees that its accommodations conform with the descriptions provided on this website. The reserved accommodation may not exactly match the photographs, but it will be of the same style, as per the description on the website.
CANCELLATION OF THE RESERVATION:
In order to cancel a reservation, the client must email Terranam at info@terranam.com to inform us of their desire to cancel the reservation. Terranam will respond, confirming the cancellation of the reservation as well as the terms applied. The terms depend on the type of reservation selected and are detailed below:
1) NON-REFUNDABLE OFFERS: If the reservation via the website is designated as a ‘Non-refundable offer’, cancellation will result in the total forfeiture of the amount of the stay, which TERRANAM is entitled to keep if it has already been paid, charge to the client’s debit/credit card or claim by any other valid means provided for by the law.
2) OTHER OFFERS: In the case of a reservation not designated as a ‘Non-refundable offer’, the client can cancel without penalty, provided that the cancellation is made more than 60 days before check-in time the day of the scheduled arrival.

All cancellations made within 60-31 days before check-in time the day of the scheduled arrival will result in the forfeiture of 50% deposit required to reserve the retreat.

All cancellations made less than 30 days before check-in time the day of the scheduled arrival will result in the total forfeiture of the amount of the stay, which TERRANAM is entitled to keep if it has already been paid, charge to the client’s debit/credit card or claim by any other valid means provided for by the law.

No-shows will result in an automatic charge to the bank card of the client of the amount corresponding to the full reservation, as well as the cancellation of the reservation.

Arrival after the commencement of a retreat, or leave prior to its completion are ineligible for refunds.

Anyone who tests positive for COVID-19 and has official proof of a positive test will receive a full refund in the form of a voucher valid for use at another retreat until the end of that calendar year's season and subject to the availability of packages and free spaces.
NO RIGHT OF WITHDRAWAL: In accordance with Article 103(i) of the Consumers/Users Act (RDL 1/2007), the consumer/user’s right of withdrawal from this contract is not applicable.
OFFICIAL COMPLAINTS FORMS: Available to the client at all establishments are official complaints forms.
JURISDICTION: Except for cases in which the client has the status of a consumer/user (in accordance with applicable legislation), both the client and TERRANAM, in arranging the reservation of accommodation, formally waive any other jurisdiction that may apply to them and agree to be subject to the Courts of the city of Madrid for the resolution of any doubt or discrepancy that may arise from the existence, application or interpretation of these General Terms and Conditions and resulting contract.
4. LIMITATION OF LIABILITY
As a customer of Terranam Wellness, you acknowledge that during a retreat you participate voluntarily in any and all activities arranged by the retreat hosts, and insofar as legally permissible, forfeit your right to any cause of action against Terranam Wellness (Terranam Consulting SL) arising from any loss or damage to person or property that occurs during a retreat.
As a customer of Terranam, you hereby agree to be responsible for your own welfare and accept any and all risks of delay, unanticipated events, inconveniences, illnesses, injuries, emotional trauma or death.
You hereby certify that you are physically fit and have not been advised to not participate, by any means or in any manner, in any activity arranged by Terranam Wellness, by a qualified medical professional.
You hereby certify that there are no health-related reasons or problems which preclude your participation in any and all activities arranged by the retreat hosts.
You hereby waive, release and discharge from and against any and all liability from your participation in the trip and in any and all activities arranged by the retreat hosts, including but not limited to, liability arising from the negligence or fault of Terranam Wellness and/or its employees and/or its collaborators and/or its subcontractors, for your death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to you including your trip to and from activities arranged by the retreat hosts.
You agree that this release shall be legally binding upon you personally and all members of your family.
5. PHOTO / VIDEO RELEASE FORM
You hereby grant Terranam Wellness the right and permission to use photos & videos in which you are featured and were taken during retreats or events at Terranam. Terranam Wellness holds the right to use this material for advertising and promotional purposes. You hereby release and discharge Terranam Wellness from any claims and demands arising out of the use of the photographs and footage, without limitation of any and all claims for libel or invasion of privacy.
6. OTHER TERMS TO CONSIDER
CHECK-IN
Check-in is between 3PM-5PM. Guest will be required to present a valid government issued photo ID and valid credit card on request.
CHECK-OUT
Check-out is at 12 PM. If you require a later check-out, please contact us before 9 am on the day of departure, and we will do our best to accommodate your needs.
PET POLICIES
Pets are not allowed.
SMOKING POLICIES
We are a non-smoking hotel. Smoking is prohibited at all times in Terranam facilities. If smoking has taken place inside Terranam facilities, a cleaning charge of 300.00€ will be applied.
AGE RESTRICTIONS
Guests must be 18 years or older to check in without a parent or legal guardian. A valid government issued photo ID must be presented at the time of check in for age verification and on request valid credit card.
CHILDREN
Terranam is an adult oriented Wellness Retreat establishment. We recognize that our guests wish to be surrounded by a tranquil and peaceful environment. Although we have children of our own and love them dearly, our accommodation’s focus is on creating an ambiance for calm. However, we welcome children over the age of 15.
ROOM KEY
You are provided with a room key during your stay and expected to return this key at check out. Should you misplace or lose the key, a 30.00€ charge for key replacement will be applied.
7. YOUR TRAVEL SAFETY
The safety of our clients and team members remains our top priority. We are proud to maintain the highest standards of cleanliness and hygiene.
In response to the coronavirus disease (COVID-19) outbreak, we have taken additional measures to make our cleaning and hygiene protocols even more rigorous.
We have increased the frequency of cleaning our public spaces and keys (including door handles, public bathrooms, etc.) and continue to use a quality disinfectant.
We have increased the deployment of antibacterial hand disinfectants.
RESTRICTIONS FOR VISITORS
Entry of visitors into Spain will be subject to the regulations and restrictions of the Spanish government in force at the time of arrival.
Clients who do not meet the entry requirements of the Spanish government, present signs and symptoms of COVID-19 or do not comply with the regulations of the Spanish Ministry of Health in force at the time of arrival will not be allowed to check-in at TERRANAM.
We will adapt our measures according to the current government directives provided by the Spanish Ministry of Health.
We apologize for any inconvenience and thank you for your understanding.
The safety and security of our guests and team members remain our highest priority. We take great pride in maintaining the highest standards of cleanliness and hygiene.
TERRANAM reserves the right to make any amendments that it deems appropriate to these General Terms and Conditions without prior notice. These amendments may be made through the company’s websites and shall be legally binding to all for the duration of their publication on the Website, except to clients who made reservations under the terms of the previous general terms and conditions, which shall remain applicable to them. TERRANAM also reserves the right to apply, in certain cases, when it deems it appropriate, Special Terms and Conditions of Contract which shall take precedence over these General Terms and Conditions and shall be announced in a timely and appropriate manner.

CONTEST RULES
· Eligibility: Customers who have previously been guests of Terranam Wellness or have an existing reservation with us are not eligible. Only guests over the age of 18 are eligible to enter the competition.
· Entry Deadline: Giveaway entry expires on October 15, 2023 at 7pm CET.
· Entry Restrictions: Only one entry per person is allowed.
· Prizes: One winner will receive a free 5 day/4 night wellness retreat at Terranam Wellness. Details included above. Transportation to and from Terranam Wellness are not included. 60 minute massages are not included in the giveaway and if requested by the winners will be charged at winners’ expense during the retreat.

Winner also agrees to write a review on Google & Trip Advisor within 7 days of the end of their chosen retreat. Winner also agree to the entirety of Terms & Conditions previously established by Terranam Wellness on its company website, bar payment of the reservation. · Publicity Release: In accepting the prize, winners grant Terranam Wellness full authorization to use their name, photo or testimonial for promotional purposes.
· Disqualification: Entering multiple times, using fake Instagram accounts or inappropriate content or not meeting the eligibility criteria will result in automatic disqualification.
· Privacy Policy: In accordance with European GDPR regulations, contest participants personal information will be used solely for the purpose of the contest and will not be shared with third parties.
· Changes and Termination: Terranam Wellness reserves the right to modify or terminate the contest if necessary should any misappropriation or fraud be identified.
